MEMBERSHIP
TERMS & CONDITIONS
1. GENERAL
1.1 By accepting the LHWY Pte Ltd (the “Company” or LHWY) invitation to become a member (“Member”), you agree to be bound by these terms and conditions.
2. INTERPRETATION
2.1 The following definitions and rules of interpretation apply in this Agreement (unless the context requires otherwise).
“Product” means the Products or Services provided by the Company (or her third-party providers) as supplemented and/or amended from time to time.
“Territory” means Singapore and all other countries and regions in the world.
3. TERM
3.1 Membership is Singapore dollar $20 and shall be valid for a period of one year.
3.2 Membership shall be automatically renewed for the following year unless the Member has written to terminate the membership or the member has breached the terms and conditions of this agreement.
3.3 Renewal of membership fee is free provide that the Member has made a purchase of a minimum of $100 in the preceding calendar year.
3.4 The relationship between the Member and the Company is that of an independent arrangement and nothing in this Agreement shall render the Member an employee, worker, agent or partner of the Company and the Member shall not hold himself out as such
3.5 The Company may terminate your membership with immediate effect for no or any reason, with or without cause, including without limitation breach of contract, misconduct, or unforeseen business conditions, by providing you with a notice in writing. Any termination of your membership (howsoever occasioned) shall not affect any accrued rights or liabilities of either party nor shall it affect the coming into force or the continuance in force of any provision hereof which is expressly or by implication intended to come into or continue in force on or after such termination.
4. MEMBER CODE
Company will deliver to each Member a QR code or Referral Code to enable the Member to use such Codes for the purpose of purchase products and/or services from the Company. Each visitor that purchases any products and/or services from the Company after arriving at the Company’s Platform via the QR code is referred to herein as a “Introduction”.
5. BENEFITS
5.1 Member is invited to register as a member of FOMO platform, an exclusive chat group where the identity of the members in the chatgroup is verified. Membership fee of $100 is waived. Link: https://lhwy.sg/fomo
5.2 Member is invited to join the core member of Peter Tan Community, an exclusive community where member learns, grows and shares about wealth, wellness, education and partnership. Membership fee of $50 is waived. Link: https://lhwy.sg/ptc
5.3 Member will continue to enjoy discounts and promotional offers for Product and Services launched by the Company or her third-party providers as supplemented.
5.4 Member will continue to enjoy free delivery within the territory (where the purchase was made), with a minimum spending of $150 for each receipt.
5.5 The Company may from time to time invite members to participate in their organised event.
6. INDEMNITY
You shall indemnify the Company and keep it indemnified at all times against all or any costs, claims, damages or expenses incurred by the Company, or for which the Company may become liable, with respect to any unauthorised act or acts carried out by you. The Company may at its option satisfy this indemnity (in whole or in part) by way of deduction from any payments due to you.
7. LIMITATION OF LIABILITY
In no event shall the Company be liable for any consequential, indirect, incidental, special, exemplary, or punitive damages, lost profits or revenues or diminution in value, arising out of, relating to, and/or in connection with any breach of these Terms, regardless of (a) whether such damages were foreseeable, (b) whether or not the Company was advised of the possibility of such damages and (c) the legal or equitable theory (contract, tort or otherwise) upon which the claim is based.
8. GOVERNING JURISDICTION
This Agreement and all related documents including all annexures attached hereto, and all matters arising out of or relating to this Agreement, are governed by, and construed in accordance with Singapore law. Any claim or cause of action arising under this Agreement shall be subject to the Singapore courts, and Parties hereby irrevocably consents to the exclusive jurisdiction of such courts
